This Privacy Policy describes how Oversize Nav LLC ("Company," "we," "us," or "our") collects, uses, and discloses information in connection with the OversizeNav application and website (collectively, the "Service"). By accessing or using the Service, you acknowledge this Policy and the Disclaimer and Limitation of Liability set out below.
1. Information we do not collect
- The Service maintains no user accounts and requires no sign-in.
- The Service contains no advertising and no advertising networks.
- The Service employs no analytics, tracking, or advertising identifiers.
- We do not sell or rent your information, and we do not share it except as described in this Policy.
2. Location information
Your device's GPS position is processed locally on your device to provide the Service's features. Your GPS position is not transmitted to us or to any third party. Three narrow exceptions involve data related to location:
- Route drawing. When the Service draws a route, the route's coordinates are transmitted over an encrypted connection to our servers solely to compute the route line. They are used only to answer that request and are not retained by us.
- Place search. When you use the place-search box, the text you type (never your GPS position) is transmitted to our servers and on to a geocoding service, solely to locate that place. It is not used to build any record of you.
- Map data. Map imagery is downloaded from our servers as you view it. Such requests carry your IP address and reflect the map area displayed, but never your GPS coordinates, and are not used to build any record of you.
3. Permit photo scanning (optional)
If you elect to use the permit-scanning feature, the photographs you take are transmitted over an encrypted connection and processed by a third-party artificial-intelligence service provider engaged by us, solely to read the permit. Permit paperwork may contain personal information such as names, company identifiers, and license numbers.
- We do not store your photographs. They are processed for the single read, and the result is returned directly to your device.
- The provider processes photographs as a service provider under commercial terms that prohibit the use of customer content to train its models, and handles them in accordance with its published data-retention and privacy terms.
- Scanning is optional and operates only after your express permission. Routes may alternatively be entered manually or read with your device's built-in text recognition; neither transmits a photograph anywhere.
4. Route problem reports (optional)
If you elect to send a problem report, the Service transmits the permit text you entered (which may include personal details printed on the permit) and the drawn route line to our servers, where it is stored so the problem can be investigated. Problem reports do not include photographs or your live location. You may request deletion of your reports at the contact address below.
5. Work-zone and closure data
The Service retrieves public work-zone and road-closure data anonymously. Such requests contain no information about you or your route beyond which state files are loaded.
6. Information stored only on your device
Your saved data — including trips, load dimensions, logs, settings, and your terms-acceptance record — is stored only on your device and never leaves it. Deleting the application deletes it.
7. Subscriptions and payment
OversizeNav is a paid subscription service. Payment is processed entirely by Apple's App Store or Google Play under their respective terms. We never receive, see, or store your payment details. Purchase status is verified with the applicable store from your device.
8. Security and retention
Every transmission described in this Policy uses an encrypted connection (HTTPS). We maintain no databases of users. The only information retained on our servers is the route problem reports you choose to send (Section 4); you may request their deletion at any time.
9. Disclaimer of warranties
THE SERVICE, AND ALL INFORMATION, DATA, ROUTES, MAPS, AND CONTENT MADE AVAILABLE THROUGH IT, ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, OR NON-INFRINGEMENT, ALL OF WHICH ARE HEREBY EXPRESSLY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
The Service is an informational aid only. It draws upon public data sources that may be incomplete, inaccurate, or out of date, and the Company does not warrant that any information presented by the Service is correct, complete, or current. THE SERVICE IS NOT A SUBSTITUTE FOR, AND DOES NOT MODIFY OR SUPERSEDE, YOUR PERMIT, POSTED SIGNAGE, APPLICABLE LAW OR REGULATION, OR THE INDEPENDENT JUDGMENT OF A PROFESSIONAL DRIVER. You are and remain solely responsible at all times for verifying your route, clearances, restrictions, and compliance against your permit, posted signage, and applicable law, and for the safe operation of your vehicle.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OVERSIZE NAV LLC OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER — INCLUDING WITHOUT LIMITATION DAMAGES FOR PROPERTY DAMAGE, CARGO LOSS, FINES OR PENALTIES, LOST PROFITS OR REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in such jurisdictions, the foregoing exclusions and limitations apply to the fullest extent permitted by law.
11. Your choices
- Location permission is optional; certain features simply do not operate without it.
- Permit scanning and problem reports operate only when you elect to use them.
- You may request access to, or deletion of, any problem report you sent by contacting us.
12. Changes to this policy
If our information practices change, this Policy and its effective date will be updated before the change takes effect.
